CASSELBERRY - In January, 1-year-old Joey Cosmillo wandered into the backyard and fell into the family pool. When his mother hauled him out, he wasn’t breathing. Rescuers were able to bring him back to life, but he suffered severe brain damage and cannot walk, talk or even swallow.

His Majesty thinks that it’s safe to say that the Cosmillo family and young Joey have suffered more than enough.

Unfortunately, they haven’t, according to some 17th-tier, mono-cellular organisms in Florida. You see, when the Cosmillos were frantically hauling their little boy out of the pool, dragging him into the house and doing all they could to save his life while they waited for help to arrive, they criminally neglected to mop the floor dry of the water that had dripped from Joey’s lifeless body:

Now, his family faces another burden: One of the rescuers, Casselberry police Sgt. Andrea Eichhorn, is suing, alleging the family left a puddle of water on the floor that afternoon, causing her to slip and fall.

We’ll leave it to you to come up with some extra-creative invective that might approach adequacy when it comes to describing Sgt. Eichhorn, that bloodless, soul-sucking, heartless, greedy cunt.

Eichhorn last week sued Richard Cosmillo; his wife, Maggie Cosmillo; and the boy’s mother, Angela Cosmillo, accusing them of negligence. They were careless, according to the suit, and allowed the home they shared to become unsafe.

Or, as Bill Quick puts it:

Not only are the police under no legal obligation to protect you, you are apparently supposed to be under a legal obligation to protect them.

Which leads us to the logical followup question: Why don’t we do away with them entirely? It’s not like they actually serve a purpose, and if they need 24-hour babysitting and protection in order to keep them from suing somebody, perhaps we should just institutionalize them. Put them in little padded cells with nice helmets on their heads and feed them strained peas three times a day. Once a week, we can hose down the room to get their feces off the walls.

The baby’s mother was the only one home Jan. 9, when the boy slipped out of the house and wound up in the pool, according to a police report.

She plunged in and dragged him out, carrying him inside, down a hallway and into a bedroom. She also called 911.

Eichhorn arrived a few minutes later. As she stepped into the room where rescuers were working on the boy, she slipped and went down on one knee, then stood back up, according to Richard Cosmillo.

Later that day, she went to an emergency care center and eventually to an orthopedist, according to her attorney, David Heil.

While she was on medical leave, Pavlis said, the city’s insurer paid her medical bills and provided disability checks.

And then, when the money ran out and she was looking the grim reality of having to work for her funds in its bloodshot eyes, she downed the last bottle of Everclear, popped a half dozen Oxycontin and called the nearest landshark to see if there was any way of sucking the blood out of the family she was supposed to serve and protect.

Her attorney said those benefits, paid by the city’s workers’ compensation carrier, were not enough. The suit seeks an unspecified amount of money.

Eichhorn, he said, is a victim. Her knee aches, and she will likely develop arthritis.

No, she’s not. She’s a clumsy cow who, lamentably, failed to break her fucking neck when she fell. Hopefully some “freak accident” will correct that omission sometime in the near future before she manages to make Joey homeless and destitute as well as permanently disabled.

If the Cosmillos had made their pool baby-proof, police would not have been called to the scene, there would have been no water on the floor, and Eichhorn would not have hurt herself, he said.

And if Sgt. Eichhorn’s mother had kept her knees together or, failing that, scooped up the best part of her sow of a daughter that ran down her legs and shoved it back inside, then the accident wouldn’t have happened either, not to mention that the planet would be a much cleaner place on top of it.

If you need one good reason for stringing every last fucking damn trial lawyer in the country up from the nearest tree and set fire to their dangling corpses to light up the night, I don’t think you can find one much better than the paragraph quoted above or, indeed, this whole lawsuit.

As to myself, I’m off to the range.

UPDATE: Aww shucks. Now Andrea “Syphilitic C*nt” Eichhorn and her ambulance-chasing scumbag of a “lawyer” have gone ahead and dropped the case. We sure hope nobody trips over it and hurts themselves, or they might be looking at a lawsuit themselves:

I remember an incident here from long ago…a lawyer specializing in getting drunk drivers off, especially those commiting vehicular manslaughter. There came a time when his daughter was killed by a drunk driver. He filed suit against the driver and his insurance company. Guess what happened when he called on the cops to testify? Not one, not one cop, and when forced to testify, favored the defense. Now karma is a real bitch sometimes…he lost the suit and his daughter.

    Somebody I know found this testimonial to the good lady sergeant from one of her fellow officers.

    “I have worked with, and known Andrea for a number of years. I can no longer remain silent. Andrea may’ve “wrestled” a box of razor blades from someone, but what Casselberry P.D. isn’t telling the press is how during an attempt to take subdue another person, she handcuffed an officer who was assisting her. This was on another call, but it actually happened. That’s not all. Casselberry is slow to release her public record, because it’s also full of negative stuff as well. Several years back, she was investigated for fraud and forgery by the F.D.L.E. for forging officers names to collect money on an off duty detail. The detail was a cash payout, and required officer signature for the company’s tax records. She was signing other names so she wouldn’t have to claim the payout on HER taxes. THIS IS PUBLIC RECORD!!!!!
    There was also the time a bank was robbed while she was working there on an off duty detail. Because of her laziness, she was unaware that the bank was being robbed, and it wasn’t until a citizen attempted to subdue the robber that she realized what was going on.
    Or, how about the squad memo she wrote, DIRECTING her squad to write a specific and large number of tickets, or face disciplinary action, thus creating an illegal quota. Once the memo was made public to the other squads, it was quickly recanted and hidden away.
    How about her inter-department sexual liasons? Although never made public, she was known for being sexually involved with people who could further her career. She was caught having sex with an officer on the back of her patrol car which was parked in a lot off of Murphy road. This was never investigated, and was swept under the rug. While having an alleged affiar with the a Deputy Chief, she was promoted to Sgt. Was she the most qualified? Absolutley not, dating the Dept. Chief doeshave it’s benefits. She started daing her current husband while he was still married( and had just had a baby ). By the way, she was still married as well. She is not a good officer, nor is she well liked at the department. Most people try to stay away from her.
    Ask yourself this….Why was a Sgt, in the Investigation Division( which does NOT answer patrol calls ) at the Cosmillo home? Was she dispatched to the call, even though she’s considered secondary to the patrol officers. What I mean, is that for her to be dispatched to that call, ALL roadway patrol officers, ALL traffic officers, and community service officers would have to be unavailable. So, that would mean somewhere between 10 and 20 other people, who would normally answer that call would have to be unavailable. Let’s not forget that Paramedics were ALREADY on scene. So, was that the case, OR did she decide to go on her own? Dispatch logs are public record and should be investigated. If she went on her own, there was NO reason for her to be on scene. Following her lawyers logic of if the family had secured the pool area, there would’ve never been a puddle, if Andrea had not taken it upon herself to go the house, she would not have fallen. I urge anyone who wants to know more about her, to request her record of service from the City of Casselberry. It’s ALL public record, and you have the RIGHT to see it. Don’t take my word for it, see it for yourself.”

    Actually, I spoke last night with several high ranking EMTs and firefighters in my family at a dinner. They have several brothers who have perished or have been injured trying to save lives. In this case, under the circumstances, her competency as a trained law officer would have been brought into question as well as every little item on her record. I emphasize that pesky word trained. See, you are supposed to assess the situation.

    IF that post regarding her work record is true, wouldn’t look too good for her. In fact, her competence could be questioned for not observing the obvious and she can, if she hasn’t already, run the risk of being posed as a danger to the public she is supposed to protect by being so careless. What if she would have slipped and falled on the baby as the rescuers were working on her? And I know that the police are not supposed to interfere nor touch a victim unless they HAVE to. I know this to be Florida State law living in Miami.

    You think firefighters who get accidently burned because a child accidently knocked over a candle or was playing with a lighter caught a house on fire has the right to sue?

    I’ve worked in restaurants as well. I’ve seen lawsuits go through where people tried to sue because their running child slipped from a wet floor by the coat and umbrella room. Cases like that get examined for contributory negligence.

    Yes…contributory negligence is ALWAYS a factor. I was speaking just from the point of view of the principle of the law. The laws (precisely stated) are different from state to state. There is a ‘firefighter’s rule’ (in NY state at any rate) that states that they cannot recover for a landowner’s failure to inspect or repair dangerous conditions that are an inherent risk of their law enforcement or firefighting activity…the lawyer would then argue that water on the floor was not an inherent danger. I would argue that water on the floor of a near-drowning could be considered inherent…no? Evidently, seeing that an attorney had taken it, there was a prima facie case (all the makings of a valid complaint). At any rate, our work here is done. The case was dropped. Now if we could get the other 20,000 dodgy tort cases per year thrown out, that’d be great.
