Plenty of “public squares” there for him to express his opinion on too.

    1st Amendment issues? Not Applicable. The first amendment states that government will not limit someone’s speech. A private funeral on private property is not the government. The civil lawsuit brings the government in as an overseer, making sure that the process runs properly, that’s all. A private citizen brought the lawsuit, and twelve citizens agreed that Phelps lost.

    As for Phelps and the gay groups. Actually, they started the protest thing with the gays when AIDS first came out. They were very cruel and the gays went undercover as far as their funerals. It’s just that he gets his message heard now to the general public.

    The elements of the above mentioned laws/regulations are centered around the creation of a nuisance or disturbance to the general public and NOT the government. IOW- You can walk to an isolated area and scream your fool head off, no foul. The anxiety and pain that their mere threat caused to the family was too much for me to ever forgive or forget….

    I have no sympathy for any of them, I will celebrate long and loudly when they start dying off from the inevitable diseases that will overwhelm their genetically defective immune systems.     I’ve read this site for about a year, and I joined just to post in this one spot.

    First off, let there be no mistake about it, the only reason I haven’t yet unloaded 12-ga. beanbag rounds at this “church” is because I’m too much of a procrastinator. My dad was in the Navy (only the reserves though), and if they show up at his funeral (hopefully a long time from now), I won’t invite them to a duel, I’ll just duel them, whether or not I have their permission, aware that I’ll face whatever the legal penalties are; they’ll be worth it.

    However, I’m going to have to have to side against the court decision on this one, and even say that I hope this gets overturned, if for no reason other than the precedent this sets. I’m talking about “you hurt my feelings, therefore you now owe me money.” In a few years, this WILL be abused.

    I actually tried to allude to that, as your solution would be picture perfect, as far as I’m concerned and yes, I am leery about government getting involved in policing speech, indirectly or not.

    But the problem is that we’ll never get the perfect solution, so I’ll just have to settle for what I can get. In this case, a civil suit by private individuals on grounds of invasion of privacy and deliberate and intentional inflicting of severe emotional distress. Now, if the government itself were to start fiddling around with passing a law against phelps the phucknozzle, it’d be a different kettle of fish entirely, even though I wouldn’t feel in the least bit sorry for him.

    But that’s not what they did. They let the family present their case in front of twelve of their peers, and those peers found phucknozzle and his inbred bastards guilty. I can live with that.
