AUSTIN – Gov. Rick Perry signed into law Tuesday a bill that gives Texans a stronger legal right to defend themselves with deadly force in their homes, cars and workplaces.

Both chambers of the Legislature overwhelmingly approved the measure earlier this month. The bill, backed by the National Rifle Association, states that a person has no duty to retreat from an intruder before using deadly force.

“The right to defend oneself from an imminent act of harm should not only be clearly defined in Texas law, but it is intuitive to human nature. You ought to be able to protect yourself,” Perry said, surrounded by lawmakers who pushed for the law.

This is the first bill-signing this legislative session by the Republican governor. The law takes effect Sept. 1.

Now, before we go outside to do the Happy Nekkid Dance™, allow us to point out the, in our opinion, most important aspect of this new legislation (because, frankly, getting a no-bill in Texas wasn’t exactly all that difficult in the past either, since we have good horse sense values when it comes to defense of life, property and health. This new law just sets the language in stone, thus making it much more difficult for a future DA with a GFW agenda and creative interpretation skills to pervert the system):

The new law will also provide civil immunity for a person who lawfully uses deadly force in any of the circumstances spelled out in the bill. Police and prosecutors can still press charges if they feel deadly force was illegally used, legislative sponsors said.

This is the real zinger in the new law. No longer will surviving goblins and/or their kith and kin be able to destroy law-abiding citizens in civil court after a shooting has been ruled justifiable by the Grand Jury.

It’s either justifiable or it isn’t, end of story.

    Naturally, Wisconsin will not have anything like this law. We can’t even get the governor to stop sucking up to the police chiefs accociation and obey the will of the majority and allow concealed carry.

    Nevada doesn’t have such a law, but no “duty to retreat” exists either. You’d be exceptionally hard pressed to find a cop who’d arrest, a prosecutor who’d charge or a jury who’d convict.
