A huge shout-out of approval to Arizona’s Democrat governor, Janet Napolitano, for signing this bill into law (and, of course, an equally loud shout-out to the State legislature who actually passed the bill):

The governor of the US state of Arizona, Janet Napolitano, has signed into law legislation designed to deter illegal immigrant workers.

The law requires businesses to verify that all their employees are legally entitled to work in the US, or face the prospect of being closed down.

Under the new legislation, an employer’s first offence would be punished by a temporary licence suspension.

A second offence would be punished by what the governor’s office called the “business death penalty” - the permanent revocation of a licence to do business in Arizona.

Ms Napolitano said she had acted because she believed Congress in Washington was incapable of tackling immigration reform on a nationwide level.

You got that right, governor Napolitano!

This, of course, is why Arbusto and his RINO/Dem Cong alliance were so hell bent on ramming through what will forever be known as “That Piece of Shit Bill of ‘07″, bypassing all normal democratic procedures and basically demanding that Senators vote in favor of a bill that hadn’t even been written yet, much less read by the ones expected to vote on it.

They had to try to push that crap through, democracy be damned, because they knew that We the People have had fucking enough of our laws being used as toilet paper by illegal immigrants, their corporate slave owners, and the Dept of Homeland Insecurity. With local anti-ILLEGAL immigration laws being passed in ever greater numbers, the D.C. weasels and the lobbyists that they’d been taking bribes donations from realized that they were becoming irrelevant, so the only option left to them was to pre-empt the will of the people by turning it into a federal issue.

It didn’t work and, ironically, as a result of their ham-fisted, totalitarian methods, their constant insults and derogatory remarks about the people who voted them into a job in the first place and complete and utter disdain for what was, according to every poll on the issue, a 60-70% majority against their idiotic bill across party lines, they’ve given the local governments even more momentum in passing anti-ILLEGAL immigration laws. We the People, thanks to Arbusto/McGraham/Kennedy et al now know, more than ever before, that if we want anything done, we’re going to have to do it OURSELVES.

And we will.

    It’s going to be tough to get it done in WA as well. This is one of those states where illegals have already been given perks like in-state tuition rates. Gov. Gregoire has been trying to extend health coverage to illegals as well.

    On KFYI radio and other talk venues they outlined her previous vetoes and challenged her to do something besides demagoguing the issue. Russell Pierce was the real force behind this bill.

    Oh, I have no doubt of that, TJ, but she DID sign it, and I give her credit for that…about the first thing she’s deserved ANY credit for.

    Yes, just like they’ve done with the medicinal marijuana laws in the states.

    The question is, does this law extend to businesses from outside of Arizona that do business in the state? In other words, if you have ACME Company headquartered in New Mexico that has franchises in Arizona, would Arizona revoke the license for ACME to do business in Arizona for practices in other states?

    Interstate Commerce laws will most likely do away with this law before it really gets started. Arizona can’t enforce the law on its own companies without violating Equal Protection for companies headquartered outside of the state.

    Alright, first things first; my governor Janet has spent her entire career dragging her feet about implimenting anything into law if it even looks like it might involve the words “illegal immigrant” and “enforcement”. This will not be any different.

    Second, the law, while looking fierce and toothy, is a paper tiger of the first order. There is no database that is readily available for employers to check.

    Third, actually enforcing the law, as in “How do you prove prior knowledge” will be tough.

    Yes, it looks nice, but it is going to be worthless without a ton of real work by the government, and that never happens because Janet N. is running the show. Never forget that she is a democrat and this is nothing more than her appearing to give a damn while riding the wave of public interest. She’d done things like this before and this is old hat for her. We know she’ll fight this tooth and nail, she always does, and she always will.

    If anything, she’s consistant and reliable. We always know what she’ll do and how she’ll do it. Her being a known quantity alone makes her a better politician than most.

    A legal challenge regarding the constitutionality of the new law is already in the works.

    Phoenix employment attorney Julie Pace said that challenge will assert that Arizona has overstepped its authority by moving into the arena of immigration law. The U.S. Constitution gives power over immigration policy to the federal government.

    Dave, I suspect that the laws of Arizona are similar to the laws of Virginia; That is ACME cannot be held liable under Arizona law for what it does in New Mexico, even if ACME is headquartered in Delaware. Each state has the right to control business practices inside it’s own borders. HR issue, if pushed hard enough. Arizona should be able to declare illegal aliens unable to work inside the state.

    Although we all know the Interstate Commerce clause will be again perverted, eventually. The question will be whether Kennedy, Schumer or McLame will introduce the legislation.

    This is a surprise from Napolitano, normally a moonbat extraordinaire, but also another welcome indication that the strong, core values sustaining side of the electorate is finally getting fired up and flexing its muscle. Enough stupid liberal, give-the-store-away crap is enough. DJ’s spout-off needed a thought/study precedent because he’s just flailing to find something to rant about, when there’s really nothing wrong with this law–it’s not about interstate commerce. There’s no suggestion that Az would revoke a business’ license for what another branch does in another state. It has to do with activities in Az and licenses to do business in Az. Might some big chain’s supply chain get kinked if their Az units get shut down for working illegals? I certainly hope so. Does that effect interstate commerce–probably not as much as different tax structures, different laws of contract, different insurance laws, different building codes, zoning, and perhaps most importantly, different and often draconian laws regarding the sale and consumption of alcoholic beverages (the NOLA always slips out). The pre-emption argument, though demonstrably wrong, was successful at a low level against a town ordinance. I don’t know if the town (Farmer’s Branch, Tx, wasn’t it?) has given up on the challenge or if it’s still in litigation. If I could afford to work for free, I’d have taken their case and I think I could’ve won it (regulating landlord-tenant relations is a fundamentally local issue). A state has a lot more resources, including a big in-house legal department under its Atty. Gen. to fight for its rights. I wouldn’t want to be Shrub’s bag man with DOJ who had to try to challenge this law in an Ariz. Fed. District Court. On the merits of the preemption argument, sure, Az can’t say who is or isn’t an illegal alien–only the national gov’t can do that. It can regulate working conditions and all kinds of business requirements for natural and juridical persons within its borders. I’d sure like to see the present SCOTUS get a shot at some of the BS extensions of U.S. Constitutional protections to aliens–they’re not citizens, they haven’t “signed the social contract” so they don’t get any of its benefits. Instead, they can have some minimum “natural law-type” protections or better yet, the same rights a U.S. citizen of the opposite sex would have had where they came from–think about it–that would be truly fair, especially to the muzzies.

    Yes, it is important that she did. But you have to realize that this is a governor who came out in favor of driver’s licenses for illegals, and who fought the implementation of the voter ID bill that was passed, overwhelmingly, by the citizens of her fair state.

    I think it’s not outrageous to question what her motives might be, but I’m grateful she signed the law, as it may probmpt other states to take this type of action that the feds WON’T take.

    Respectfully, I disagree. It wouldn’t be much of a stretch to say that companies that do business in several states across the southwest may very well end up facing very different consequences for employing the same person in one state than they would in another. Considering the different permutations that I have seen the Commerce Clause successfully applied to (LOPEZ being the most indefensible I can recall at the moment), I believe that using it against this law is not so terribly far-fetched. However, since this law appears to be based primarily on someone’s legal status as a citizen…an area governed entirely by federal law…the preemption arguement will be the winner here, which is as it should be. Immigration, to our eternal sorrow, is a federal matter, which leads to uniform application, or perhaps more appropriately, inaction, rather than 50 fiefdoms enacting a patchwork of unequal if not contradictory laws on the subject. Whether we like it or not, change will have to come on the federal level if it is to be lasting.

    People on the left/liberal side have thought that about Bush for awhile, but it used to be an opinion you had to hide.

    DJ, it’s usually advisable to do your homework before you spout off.

    I needed to do homework to ask a question and put forth a thought? It was off-the-cuff, but a valid legal argument. I wasn’t in any way endorsing the argument, simply stating it.

    D.J. scoffed at the idea that there would a federal challenge to this bill. There already is one.

    Of course there are going to be challenges to this law.

    For the record, I think the law is a good start. Flawed, obviously, but a step in the right direction. It needs to be federal, with serious teeth. At the same time there needs to be funding for it.

    As far as the database, since you Conservatives are so keen on privatization, there is already several sources available for information at the fingertips about everyone in this country. Many employers already use Choicepoint for background checks on future and present employees.

    Sorry, D.J. but it sure seemed to me,based on your post, that you were scoffing at the idea that this bill would be challenged.

    I agree that the law is a good start, and it might lead to some real solutions to this problem.

    I am pretty convinced though, that this one isn’t going to be enforced…at least, not in its current form.

    There are already laws in place that require employers to check the legal status of their employees. I keep hearing this excuse that they can’t possibly check out all of their employees, and I call bullshit.

    Most employers are doing background checks on their employees now, prior to hiring them. They are doing drug tests. They CHOOSE not to check for their legal status because they already know the employee is illegal. Instead they use the ‘burden’ excuse.

    Well, if it is such a ‘burden’ to prevent illegal activity, then they have no business being in business. They are admitting defeat to criminals and have become criminals themselves.

    Well, I’m not the only conservative in AZ that doesn’t think this law will ever beat the challenges and be enforced…but there is scuttlebutt that it’s making a lot of employers, “nervous,” so maybe it will make them think twice, anyway, about knowingly hiring illegals!
