    Lewis Libby was convicted for lying about a crime which never took place.

    Not quite.

    He was convicted of lying to federal agents and the Grand Jury in the course of an investigation into determining whether a crime had taken place or not. Like it or not, THAT is a crime. It doesn’t matter whether the investigation itself turned up a crime, if you impede the investigation by lying, then you’ve committed a crime.

    That is what Libby was convicted of doing in four out of five separate counts.

    The same special prosecutor who prosecuted Libby found that the disclosure of Valerie Plume’s work for the CIA was not a crime.

    Not quite.

    What Fitzgerald said was that Libby had poisoned the well to the extent that it would be impossible to determine whether a crime had been committed. Hense, the reason why Libby was charged.

    Libby will get his pardon. Just not right now. As long as he is still under sentence and under appeal, he cannot be compelled to testify in front of Congress.

    How many other “excessive sentences” is President Bunnypants going to commute, now that he has determined that one particular sentence within the federal sentencing guidelines is excessive.

    Perhaps you were unaware, but when determinate sentencing was implemented in the mid-1980s, it took almost all discretion away from the court. Each crime had a sentencing guideline that determined the seriousness of the crime, prior criminal history of the defendant (which treats multiple current convictions as past criminal history), acceptance of responsibility, role in the offense to come up with a sentencing range. That range usually has a spread of about 12 months, and the judge can choose somewhere within that range.

    In another thread, someone brought up Sandy Berger’s light sentence as a comparrison for Libby’s “excessive” sentence.

    Sandy Berger pled guilty to a lessor charge. Pleading guilty is an acceptance of responsibility in the crime, and points are shaved off of the “offender score”. Libby took his five charges to trial. He was convicted of four of those charges, each charge adding points to his offender score. Because he didn’t accept responsibility for the crime, he was given additional points for each charge.

    This is how the system works.

    By Bush determining that Libby’s sentence was “excessive”, he was opening the door to say that all other sentences are excessive also.

    The White House was complaining the other day about the six hundred plus investigations Congress has been doing since January. But it doesn’t even come close to the thousands of investigations Clinton was subjected to.

    As I recall, this President ran under having an administration more transparent than the previous one. Instead, it has become the most secretive administration since Nixon.

    Fitzgerald pulled a lot of stuff out of his ass in his closing arguments, that amount to the equivelent of what Mike Nifong did pre-trial.

    BEFORE LIBBY WAS IDENTIFIED TO BE INTERVIEWED, we knew:
    1) Valarie Plame was outed by Richard Armitage, a well known gossip monger at State. Armitage was so well known as a leaker that he was used as a semi-officail source to the press on a number of occasions. He never knew a secret he didn’t run his mouth to SOMEONE about.

    2) Valarie Plame was not a covered agent under the definition of the Identities Protection Act, which is what was being alleged by her husband. She was not covered because; a) She had been in-country for six years prior to the alleged offence (the law specifies “covert activities outside the United States within the preceeding five years”). b) She personally told non-cleared personnel where she worked, who she worked for, had a Langley parking decal on her car, and was introduced by her husband at parties as “my secret agent trophy wife”. c) Her identity was not being actively protected by the agency. Indeed, she was an intelligence analyst, and was listed as an analyst on the CIA website at one point. d) She was listed in the publicly available publication “Who’s Who in Washington D.C.” as a CIA employee. e) Ah, hell, lets not even go into the “Vanity Fair” article where she was interviewed before Joe went to Africa.

    3) That Valerie Plame had indeed suggested that Joe Wilson be sent to Niger, due to his “unique connections” in the country.

    4) That Joe Wilson lied either in his New York Times Op-ed, or lied to the CIA in his debriefing, because the official record of his debrief was the opposite of what he wrote for the Slimes.

    Most of the above, the Justice Department knew before Fitzgerald was appointed.

    Fitzgerald, at the absolute BEST, played fast and loose with the facts in his closing arguments. Arguably, he knowingly lied to the jury to get his high profile scalp to further his career.

    After all, that’s the tradition in Washington - you advance by fucking someone while wearing a sandpaper condom.

    I don’t pay attention to DU, Freepers, or any of the other crap out there. I just go with what I know on this topic. I am sorta of an expert on the federal sentencing guidelines as it explains how the court decided on the sentence. You didn’t like the sentence, but I assure you, it fell within the standard range on the guidelines.

    As far as the other — well, you gotta go with the obvious here. Bush hasn’t been in the habit of commuting anyone’s sentence until now, and only this one gives him cover.

    When are you going to step back and see things like everyone else is seeing them? You need to cut this guy loose — he’s Nixon in a clown suit.

    Deej, sometimes I wonder if you really just are as stupid as you act or you merely like to act like it for our entertainment.

    Even if 99.999% of the country decides to be an absolute idiot on some particular issue, that doesn’t make them right just because they and “everybody” else thinks they are. And the “everybody” who sees things your way on this issue is FAR smaller than even a majority, much less “everybody”.

    Oh, and btw, we’ve been jumping on Bush so hard — on nearly everything, in fact — the guy has to be about three inches tall by now. But when the guy finally gets something right (and I could probably count the times he has on my fingers and maybe a toe or two) you jump on him and accuse him of coverups. Get a grip. Not everybody can be wrong all the time. Not even your heros teddy-hic!-kennedy and nancy-pukelousy or even saint she-hag can be 100% wrong 100% of the time… although they come closer than just about anybody I’ve ever seen. But even they have their occasional moments of sanity. Bush got one right for once, give it a rest already.

    Oops, that should have been “Nobody can be wrong all the time” rather than “Not everybody…”… well most of you probably figured that out on your own, but for the few who didn’t…

    And perhaps I should say “got one less than totally wrong” rather than “got one right”. Because what he should have done was give the poor guy an outright pardon and then find some attorney with ethics (yeah I know, a rare breed, but a few do exist) to charge Fitzgerald with a few dozen charges like abuse of authority and lying to a jury or whatever you can find that is actually illegal (rather than merely detestable) from what the bastard did.
