Mark Steyn elaborates on the case of two vile child molesters, initially charged with felony sexual assault but now “downgraded” to five misdemeanor counts of sexual abuse and five counts of sexual harassment, crimes that carry lifetime inclusion in a sex offender database and up to ten years in the slammer if convicted.

The crime committed by those two very dangerous criminals, I hear you ask?

They slapped some of their female seventh grade classmates in the butts on what the students call “Slap Butt Friday.”

I’d like to slap something too right now. With a nail-studded ClueBat™. Repeatedly. Until their brains run out their ear canals.

UPDATE: Thanks to LC EFA, here’s another example of prosecutorial prickheadedness, a guy being charged with two counts of felony for throwing a koran in a toilet.

Yep, that’s two felony charges for throwing a book in a toilet. Thoughtcrimes — it’s not just for Nazi Germany and the Soviet Union anymore.

The ghost of Nyfong continues to haunt this country. Unfortunatly there are to many prosecutors like him who have no common sense, and only care about scoring another victory.

Eventually some moron prosecutor or DA is going to go after someone who decides they have nothing to lose. That’s when the body count will start climbing.

We need to have the ability to sanction, (No not like the Eiger Sanction although throwing a few off a mountain does hold some attraction), prosecutors who do things like this. The immunities they enjoy need to be removed when they engage in egregious stupidity.

Confiscation of all of their property to be handed over to the victims of their abuse, coupled with a few years in GenPop in the nearest penitentiary would seem like the perfect solution to me.

To pass time while in there, they can catch up with some of the perps they helped land there. I’m sure they’d have a lot to talk about.

I saw the interview with one of the kids and his attorney the other day on FOX News (purely by accident, mindjya)

What a complete waste of time and taxpayer money. (at least $15k per trial, and upwards of $30k on appeal if it goes that far)

What ever happened to calling the parents in for a sit-down? Maybe a few days worth of detention?

From the interview I watched, I gathered that this was a regular thing that a lot of kids participated in.

Off-topic, but funny enough that I felt I should share:
    ——————————————————

A man dies and goes to hell. There he discovers that he has a choice: he can go to capitalist hell or to communist hell. Naturally, he wants to compare the two, so he goes over to capitalist hell. There outside the door is the devil, who looks a bit like Ronald Reagan. “What’s it like in there?” asks the visitor. “Well,” the devil replies, “in capitalist hell, they flay you alive, then they boil you in oil and then they cut you up into small pieces with sharp knives.”

“That’s terrible!” he gasps. “I’m going to check out communist hell!” He goes over to communist hell, where he discovers a huge queue of people waiting to get in. Eventually he gets to the front of the line and there at the door to communist hell is a little old man who looks a bit like Karl Marx. “I’m still in the free world,” he says, “and before I come in, I want to know what it’s like in there.”

“In communist hell,” says Marx impatiently, “they flay you alive, then they boil you in oil, and then they cut you up into small pieces with sharp knives.”

“But… but that’s the same as capitalist hell!” protests the visitor. “Why such a long queue?”

“Well,” sighs Marx, “Sometimes we’re out of oil, sometimes we don’t have knives, sometimes no hot water…”

Our judicial system has truly fallen apart if “Spanking Day” is going to ruin the lives of two 12 year olds.

And whom, may I ask, contacted the prosecutor’s office to press charges in the first place? The parents of one of the “bum-abused” children?

We used to get birthday spankings as kids. Should my parents be in prison right now?

This country has got to get a grip or we’re going to turn into Sweden or Denmark where “offending” a fellow citizen gets you jail time.
Doesn’t anyone have a sense of humor anymore? Is there no such thing as a prank? Horseplay? Harmless butt patting?

What’s next, are we going to start arresting NFL players for felony sexual assault? With all of the “butt patting” going on in that sport, I think the entire league should be put in jail!!!!

Uh-huh! Two 12-year-olds charged sexual assault for playground rough-housing which wasn’t even that rough. No reason why the girls couldn’t have hit them back. Maybe they did. A Jewish student charged with a “hate crime” for dumping a koran into a toilet. The police state is closing in fast. Although, I do wonder why a mob of illegal mexicans were not charged with a hate crime for flying our American flag upside down underneath the mejicano one during one of their demonstrations earlier this year. Very disrespectful and insulting.

It’s legal to burn the flag. I think flying it upside down is less eggregious, although I think it was in Iowa that a couple people were arrested for that. Its a very stupid thing to do for your cause, because you just piss off a lot of Americans.

I think my police state concerns are different from yours, but to go into it would invite grief.

I do think it was really stupid to prosecute kids for slapping butts. It sounded like a lot of people did it, but these two got singled out.

I think flying it upside down is less eggregious,

Flying the flag upside down is an international distress signal of “We are in deep shit, send help now!”

It’s kind of like firing a red flare into the air. You can fire white flares all you want, just to watch the pretty fireworks.

But if you start popping red flares up from your boat, and you DON’T have an emergency, you can expect those nice young gentlemen from the Coast Guard to slap the cuffs on you and haul your ass to the nearest county prison just as soon as they can get there.

had no idea flying the flag upside down is a distress signal on a boat. live and learn. I don’t know if it would have the same effect your house. I don’t own one–don’t worry about my doing anything weird (with a flag).

That site was weird. It almost seemed like it was Israeli, but there was a click to see an article in French. It’s not a news site. The site title is an insult to Muslims (halal being permissable food). It’s whole function is to demonstrate screwy things about Islam, so I would expect they would find the prosecution of the toilet things unhinged (they are).

Their sponsors are weird–farming equipment in Canada and Chinese botanical extracts (given their quality control with the antifreeze compound in the cough syrup and toothpaste instead of gycerol, I would be a bit suspect). Actually, that’s a bummer, since I’m always scouting for rare plant compounds.

I remember one day in Elementary School, two students from the fourth and fifth grades were selected each week to hoist the flags each morning at 8:00.

One morning, at around 8:30, the principal came over the PA system to inform us that he would be discussing something later in the day with us. He came by later to tell me that the two students had unknowingly hoisted the American flag upside down that morning, and that no less than three military veterans or service members had contacted 911 (inside of 30 minutes) because they saw the flag flying upside down as they drove past the school.

It’s a distress signal on land or at sea.

All I can say is thank Heaven I went to school back in the days when kids were allowed to be kids and the PC/Mind Control/Thought Police were still on the outer fringes.

History wasn’t filtered through a Liberal sieve. We were actually taught reading, writing and arithmetic. P.E. hadn’t been banned. Sex education wasn’t taught till 7th grade, and even then was a strictly PG biological version. Your parents were expected to fill in the details. As a matter of fact, you parents were actually expected to be…well…parents. Schools were…schools. Not daycares.

We stood and said the Pledge of Allegiance in the mornings. “Under God” included. We said Grace before leaving our rooms to go to lunch.

We drank imitation orange drink and chocolate milk and even had dessert with lunch. Christmas, Valentine and Easter parties were the highlight of the year. Lots of candy, cookies, and cupcakes. We passed out presents and decorated trees were in every room at Christmas. We were allowed to sing Christmas Carols. There was a Nativity in the School Office.

We chose sides for games…and if you were the last one picked, you learned to live with disappointment. We had iron monkey bars sitting on asphalt playgrounds. We played Red Rover and Dodge Ball with all the passion and fervor of William Tecumseh Sherman rolling into Savannah. We got into fights. We skinned our knees, bumped our heads and occasionally broke a bone or two. There were winners and losers. Sports were actually competitive. The best came in first…the rest came in last. You learned the meaning of “The Thrill of Victory and the Agony of Defeat”.

If you screwed up, the teacher took you to the Principle’s office and you got a paddling. If you REALLY screwed up…the Principle called your parents and they were in the office and you STILL got a paddling..usually by your parents with the Principle standing there watching (and the Secretaries in the outer office laughing it up).

We got our first kisses on the playgrounds. Held hands behind the teacher’s back. Hearts broke when that “special someone” decided they liked someone else more. We learned that if we didn’t keep our grades up and study hard we would be held back a year. The ultimate humility, and a very strong motivator.

You learned real fast that negotiating never worked with bullies. You knocked the crap out of them or you were sure to be their chosen target for the entire year.

We all rode the school bus to and from school. The Bus Driver was in charge and you didn’t dare do anything to cause them to call your parents (and they made sure to have everyone’s phone number at the beginning of the school year) or report you to the Principle. We sat in our seats and kept quiet. Talk back or make a smart ass comment or start a fight and you found another way to school.

I’m so thankful that I was allowed the kind of education that didn’t coddle me, deceive me, or shelter me from screw ups or disappointments. I was certainly alot better equipped to face life than I would have been if I were in school right now.

Not only should these boys not be Nifonged for taking part in Slap Butt Friday, the practice should be extended to include public officials.

It should be upgraded to Ass Kick Friday, and each public servant should receive a good swift ass kicking to keep him humble. Here I see a principal, a police officer, and a district attorney who ought to be first in line.

As to using a koran to clean the toilet - it defiles the toilet. Best to bury it with the bacon grease and be done with it.

The juxtaposition of two words (in boldface) caught my eye:

Messrs Mashburn and Cornelison are pupils at Patton Middle School. They were arrested in February after being observed in the vestibule, swatting girls on the butt. Butt-swatting had apparently become a form of greeting at the school – like “a handshake we do,” as one female student put it. On “Slap Butt Fridays,” boys and girls would hail each other with a cheery application of manual friction to the posterior, akin to a Masonic greeting.

My irony meter just turned up to 11.

On the Matter of the Soggy Koran:

Out of ’sensitivity’, I think the offender will likely be sentenced to a public stoning - probably at the WTC memorial site…

    Current

    Background

    More Background

In that last one, the parallel is made between this and ‘burning a cross on someone’s yard’ or ‘painting a swastika on someone’s locker’.

But in considering both such cases, the ‘hate-crime’ part is appended to the crime of vandalism of someone’s property.

Likewise, after shouting racial epithets at someone, the ‘hate-crime’ part is appended to the ‘verbal assualt’ part.

In short: until now, SOMEONE had to be the VICTIM of a crime for it to become a ‘hate-crime’ - checking around, I don’t see anything that suggests that our ‘perp’ STOLE the soggy Koran in question from someone else (making them the victim of theft/burglary).

Apparently, this is straight ‘Thought-Crime’ prosecution.

General Patton would have had a good laugh over this asinine affair, except that what these two children are going through isn’t funny at all.

I heard an interview with one of the boys on the radio. He was quite articulate and very composed considering his situation. He said that he was taken to a juvenile detention center and kept there for three days without being allowed to call his parents. His lawyer stated that his “roomie” was a 17-year-old repeat offender who kept telling him that he would never see his family again.

The legal fees must be staggering.

I don’t see anything that suggests that our ‘perp’ STOLE the soggy Koran in question from someone else (making them the victim of theft/burglary).

From what I’ve learned from reading more about the case elsewhere he did, in fact, lift a copy from the “meditation center” at Pace which, obviously, means that he’s liable for the value of said copy and that you could, justifiably, nail him for theft. But that isn’t what they’re going after him for, presumably since they can’t ramp that one up to felony status and they and CAIR are out to destroy the guy first, bothering about actual justice second, if at all.

Cannon Fodder - I don’t know the specifics of the jurisdiction where the school is, but there are a number of crimes (such as sexual abuse or harassment) for which charges can be brought by the police, even if the victim does not want to press charges.

I heard an interview with one of the boys on the radio. He was quite articulate and very composed considering his situation. He said that he was taken to a juvenile detention center and kept there for three days without being allowed to call his parents.

If that is an accurate account, I cannot even fathom what my own response would have been if I were one of the parents. What happened when my mother-in-law falsely accused us of child abuse was bad enough. I was literally in a daze for the next two months while that was sorted out, because of the fear and anger that I was feeling, and my son was staying at my parents during this time. I can’t imagine what I would have done if he had been completely cut off from us.

read the Steyn article on this in today’s NY Sun editorial section. he relates the case to the larger societal problem of losing all focus and sense of perspective on things (as posters have said above as well).

I see it, also, as politically correctness gone mad.

    Alan K. Henderson,

My irony meter just turned up to 11.

You aren’t kidding once you’d pointed out the name of the school. I wonder what the general’s opinion on it would be?

It’s too bad that the two boys are getting the zero tolerance treatment, even though their actions are clearly problematic.

    Kinda like the Jena Six.
