    Licensing leads to restrictions/confiscation. Not to mention licensing implies the state is granting permission. The state does not grant liberty and rights, it/they are pre-existing.

    Background checks ensure a person is not prohibited due to their own actions disqualifying them. Licensing ensures the person has sufficiently acquiesced to the state that the state gives them permission to exercise their right. Apply that logic to buying a newspaper, or to running a blog, or even visiting one.

    As a general rule felons are prohibited from possessing a firearm. Used to be only felons. But now misdemeanor crimes of domestic battery are disqualifying as well. As is having an injunction against domestic violence filed against you, even though they are issued like candy now during divorce proceedings.

    Misdemeanors are misdemeanors for a reason. Some poor sap gets in an argument with his wife/girlfriend, neighbors call the cops, they live in a jurisdiction with a “shall arrest policy”, she claims “he shoved me”. No marks, no proof, no nuthin. Misdemeanor domestic battery arrest, probable conviction, loss of a civil right. We need gun control laws alright, we need fair ones that make sense.

    Not nearly as rare as one would suppose. Quite often, studies have shown that is nearly as frequent as male on female abuse, but is not reported as often, because, well, how often is a man gonna call the cops and say that his wife / girlfriend / etc. is beating HIM up?

    In addition to the comments from the usual suspects, above:

    Criminal screening is currently required by Federal law, and seperately by most States. The extent varies from jurisdiction to jurisdiction, but as a minimum, there is a Federal Criminal History check done thru NLETS (National Law Enforcement Telecommunications System, the FBI / Marshal’s database that is available to all sworn LEOs.) Screening for mental illness is a handled a bit differently, and the laws are undergoing change as we speak. Currently, one is barred from purchasing a firearm (permanently) after having been admitted to a mental institution involuntarily, or for being adjudged mentally incompetent. There is proposed legislation to prevent anyone from purchasing a weapon for having EVER been treated for any form of mental illness, and to include that information in the NLETS database.

    Note that if one has been involuntarily adjudged insane / mentally ill and admitted to a mental institution, there is no systematic method for removing that from one’s record, even if the diagnosis was obviously false. In, for instance, Virginia (my state of residence), to remove oneself from this database requires a superior court judge, following a hearing in which the State is REQUIRED to put on a case against the petitioner.

    Also, in some States, Alcohol Abuse (including attending AA meetings) is considered Mental Illness. Ever having a restraining order for “domestic violence” is a permanent bar in some jurisdictions.

    My thought is that there way too damn many ways to get on one of these list.

    If someone is convicted of a felony, they are stripped of many of their rights (that’s the risk you take when you commit a crime).

    Included in the list of rights you forfeit are:
